Terms of Service. These terms are subject to the Chit Chat Holdings LLC General Terms and Conditions. Prices, offers and programs are subject to change without notice, may not be available with all devices or in all markets/retail locations, or combinable with other promotions/options. Activation of account will occur when sufficient funds are added. Monthly service charges are not refunded or prorated if service is terminated or modified before your next payment date. Unused monthly services, including, but not limited to, plan minutes, messages or data allotments, expire at the end of each month or when a customer switches service plans and do not carry forward. Partial minutes of use are rounded up to the next whole minute. Switching between Chit Chat Mobile service offerings may result in a new prepaid account. State, local sales taxes and fees may apply when adding funds to your account

Nature of our Service. Our rate plans, customer devices, services and features are not for resale and are intended for reasonable and non-continuous use by a person using a device on the Sprint network. The primary use of your device must be for domestic purposes within the Sprint-owned network and for other purposes outlined in our offers. Domestic means use in the 48 contiguous states, Hawaii, DC, Puerto Rico and the Virgin Islands. Chit Chat Mobile may limit or terminate service if you move outside of the Sprint owned-network.

 

UNLIMITED DOES NOT MEAN UNREASONABLE USE. To ensure that all customers have access to reliable services provided at a reasonable cost, you may not use our service in a manner that interferes with another Chit Chat Mobile customer’s use of our service or disproportionally impacts Chit Chat Mobile’s network resources. Chit Chat Mobile reserves the right, without notice or limitation, to terminate individual calls, or after providing notice to you, offer you a different service plan with no unlimited usage components, limit data throughput speeds or quantities, or deny, terminate, end, modify, disconnect or suspend your service, or decline to renew your service, if you engage in any of the prohibited voice or data uses detailed below or if Chit Chat Mobile, in its sole discretion, determines action is necessary to protect its wireless networks from harm or degradation. Examples of Prohibited Voice Uses. Chit Chat Mobile voice services are provided solely for live dialogue between, and initiated by, two individuals for personal use & as otherwise described in this policy. Chit Chat Mobile voice services may not be used for any other commercial purposes including, but not limited to, conference calling, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing, autodialed calls, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between two individuals. Examples of Prohibited Data Uses. Chit Chat Mobile data services are provided solely for purposes of web browsing, messaging, and similar data activities. You may not use the data service: (1) with server devices or host computer applications or other systems that drive continuous heavy traffic or data sessions, including, but not limited to, disproportionate web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections, peer-to-peer (P2P) file-sharing applications broadcast to multiple servers or recipients such that they could enable “bots” or similar routines; (2) as a substitute or backup for private lines or frame relay connections; (3) to send or receive unusually high numbers of messages; (4) to engage in atypical web usage behaviors; (5) for any activity that adversely affects the ability of other people or systems to use either our wireless services or other parties’ Internet-based resources; and (6) for any other reason that, in our sole discretion, harms our network. Chit Chat Mobile does not guarantee a minimum throughput speed and, at our discretion, may limit data throughput speeds. UNLIMITED USE PLANS. If you subscribe to rate plans, services or features that are described as unlimited, you should be aware that such “unlimited” plans are subject to these Chit Chat Mobile Prohibited Network Uses and Chit Chat Mobile’s General Terms and Conditions.

Estimated data used On each data feature is an estimated usage based on research of the industry standards.

Messaging (text, picture, video, email and IM): Domestic and international messaging rates are subject to change. Standard message rates are charged when a message is sent or received, whether read or unread, viewed or unviewed, solicited or unsolicited. There is no guarantee messages will be received and we are not responsible for lost or misdirected messages.

Taxes and Surcharges Stated prices for our services do not include certain taxes or surcharges. We charge state and local sales taxes on some purchases made through our website at www.chitchatmobile.com Charges may also include a surcharge for federal and state Universal Service Fund contributions and state and local 911 fees, as well as a cost recovery surcharge. The amount of these surcharges is subject to change and may vary from time to time and by geographic area. Surcharges are assessed to help defray our costs incurred in complying with federal and state telecommunications regulations. Surcharges are not taxes or fees that the government requires from consumers. Taxes, fees and surcharges are subject to change without notice.

Disputed Charges If you think that there has been an error in any charge to your account, you must notify us promptly after the charge appears on your account. Call Chit Chat Mobile at 1-316-243-9133 or visit a company owned store, and one of our advisors will investigate your claim. If you do not promptly notify us, you waive any right to dispute the charge, including in arbitration or a court proceeding. If we determine that the disputed charge was inappropriate and was raised by you in a timely manner, we will credit, refund or provide other compensation to you. If we credit, refund or provide other compensation to you to settle a disputed charge, you agree that the dispute is fully and finally resolved and not subject to further proceedings. We are not liable for any charges for products or services provided by third parties through and for use on our mobile phones, devices and network. If an unauthorized or disputed charge for a third-party product or service appears in your account history, you must contact that third party directly.

Account Suspension Related to Credit Card Chargebacks If we have attempted to charge your registered payment method for a charge that we deem is authorized and valid under the Terms of Service, and the credit/debit card company withholds such payment because the charge has been disputed (a “Chargeback”), we reserve the right to suspend your access to our service for up to 30 days until the Chargeback is reversed. If the Chargeback is not resolved and reversed, your account will be deactivated at the end of the 30-day period and we will assess you a termination charge equal to the prorated balance of your account, which is not refundable. Returning Your Mobile Phone or Device Mobile phones and devices purchased directly from us through our website at www.chitchat.com or in our company owned stores may be returned for a full refund within 30 days of purchase. You must have the original receipt, packaging materials, all components, and device must be in the same condition it was when purchased. Please contact Chit Chat Mobile location or call us at   for instructions.

Mobile phones and devices purchased at a retail store may be returned to that store in accordance with the store’s return policy. Please repack the mobile phone or device and all components and bring it to the store at which you purchased it.

In all cases of device returns, a restocking fee may apply. The restocking fee is equivalent to 25% of the device purchase price.

Lost or Stolen Equipment If your mobile phone or device is lost or stolen, you are responsible for charges incurred until you notify us of the loss of your mobile phone or device by visiting our website at www.chitchatmobile.com or by calling Chit Chat Mobile at 1-316-243-9133. Upon receiving notice that your mobile phone or device is lost or stolen, we will suspend your account. If you do not either activate a new mobile phone or device, or notify us that you have found your old mobile phone or device within 60 days of the suspension of your account, your account will be deactivated, we will assess you a termination charge equal to the balance in your account, which is not refundable, and, if applicable, you will lose your phone number.

 

Mobile Phone Number The mobile phone number we provide for your use is and will remain our property. If you cancel your service or your account is deactivated, we may give the mobile phone number to another customer without notice (unless you transfer the mobile phone number to another telecommunications provider in accordance with applicable regulations). You can request to change your mobile phone number at any time a $15 MDN Fee will be assed per phone number change.

 

Keeping Your Old Phone Number Depending on where you live, you may transfer an existing wireless or wireline carrier telephone number to our service for use as your mobile phone number. To switch an existing phone number to us, contact Chit Chat Mobile location or call 1-316-243-9133. Before you call, or arrive at a Chit Chat Mobile store please have a bill from your existing wireless or wireline carrier available. When you switch from another wireless carrier to Chit Chat Mobile, you may have to pay a termination penalty to your former carrier if you terminate your contract early. We will not reimburse you for any fees imposed by other carriers.You will not be able to switch your area code without receiving a new local number.

  • 911/E-911 Surcharge – a local or state-imposed surcharge to fund the 911/E-911 systems in your jurisdiction. Varies by location per month
  • Federal Universal Service Charge – a federal-imposed surcharge on telecommunications services
    Varies yearly, every quarter.
  • State Universal Service Charge – a state-imposed surcharge on telecommunications services (not applicable in all states) Varies yearly, every quarter.
  • Telecommunications Tax – a state-imposed tax on telecommunications services, sometimes named differently than telecommunications tax (not applicable in all states) Varies per state per month

One-time and Non-recurring Fees
(these fees are charged per occurrence)

  • Activation Fee – applies to all newly activated Chit Chat Mobile handsets, charged per device upon activation  $15.00 per device.
  • Shipping Fee – applies to all purchased devices from Chit Chat Mobile, charged per device upon order $10.00 per device
  • Returned Items Fee – applies to all returned and dishonored payments by your financial institution, including chargebacks on credit cards and non-sufficient funds on checks and electronic transfer. $35.00 per incident
  • MDN Change Fee – applies to changing phone a number on an active account. $15.00 per device.
  • ESN Change Fee – applies to customer upgrading or their device on an active account. $15.00 per device.
  • Restocking Fee – applies to all returns of working devices. Equivalent to 25% of the device purchase price
